1.0 EXECUTIVE SUMMARY

MGIC Australia Pty Limited (ABN 93 120 741 175) ("MGIC"), provides lenders mortgage insurance and other products and services to mortgage lenders, investors and loan servicers. Privacy is important to us and MGIC is committed to protecting your personal information in accordance with the Privacy Act 1988 and the National Privacy Principles.

2.0 COLLECTION OF PERSONAL INFORMATION

In the course of providing lenders mortgage insurance and other products and services, we collect and maintain information about our customers, other companies involved in the loan transactions we insure, and consumers who are the borrowers on the loans submitted to MGIC for insurance. Personal information that we collect includes an individual’s name, address, loan application details, employment history, payment history, credit information and information related to property owned or purchased by borrowers.

Personal information ordinarily is collected from the lender, mortgage broker, credit bureau or other organisation or person involved in the loan transaction we are asked to insure. However, we will collect personal information about an individual directly from that individual where reasonable and practical to do so. In the event that we collect personal information about an individual from someone other than that individual, we will take reasonable steps to ensure that the individual is aware of MGIC’s Privacy Policy.

We collect your personal information as required to conduct our business, including these purposes: underwriting insurance, analysing risk, processing payments, investigating and processing claims, reinsurance transactions, financial planning and accounting, regulatory compliance, and to obtain services from our professional advisers (such as lawyers, accountants and auditors).

Any credit reports that we obtain will be used in accordance with Part IIIA of the Privacy Act 1988.

We retain information, including personal information, as reasonably required to conduct our business and in compliance with the National Privacy Principles and other applicable law. When personal information and other confidential business information is no longer needed, we will dispose of it in a manner designed to protect against unauthorised access to or use of the information during destruction.

3.0 USE AND DISCLOSURE OF PERSONAL INFORMATION

We use and disclose your personal information for the same purposes as the purposes for which it was collected. We also may use and disclose your personal information as reasonably necessary in order to prevent, detect, investigate, prosecute or punish fraud or other offences, or with your consent.

We may disclose your personal information for these purposes to our related bodies corporate and to other organisations and contractors we engage to perform services for MGIC to assist us in our business operations. This may involve your personal information being stored and processed in a country other than Australia. We require that these organisations adhere to our confidentiality and information security requirements and to the National Privacy Principles.

MGIC will not disclose your personal information to an organisation or contractor that is not a related entity unless the disclosure is required or authorised by law.

MGIC has implemented and maintains a comprehensive information security program designed to protect the security, confidentiality and integrity of your personal information and other confidential information in accordance with the objectives of the National Privacy Principles. As part of our program, we maintain policies and practices designed to:

  • protect against any anticipated threats or hazards to the security or integrity of personal information; and
  • protect against unauthorised access to or use of personal information that could result in substantial harm or inconvenience to you.

Our security measures include access controls on computer systems, access restrictions at physical locations where confidential information is maintained, encryption of confidential information transmitted electronically, employee screening, and monitoring of security measures, both internally and in connection with personal information disclosed to third parties.

5.0 ACCESS TO PERSONAL INFORMATION

If you request, we will provide you with access to your personal information that we have collected (see “Contacting MGIC” below), subject to certain exceptions allowed by law. We will give you the reasons why if we deny access to any of your personal information. If you establish that any personal information we hold about you is not accurate, complete or up-to-date, we will take reasonable steps to correct the information (see “Contacting MGIC” below).

MGIC’s commitment to privacy extends to our Website as well. You can visit and browse our website without providing any personal information. Some features of our website are available only to registered business users. We will not collect personal information from you through our website without telling you what information will be collected and how it will be used.

If you send us an e-mail message, we may store your e-mail address and may use the information you send to us. We do not consider information sent to us in unsolicited e-mail messages as confidential and you should not send any personal information or other information you do not want us to use. However, we will not use your name without telling you in advance.
